Sessions court sets aside lower court order to summon police

A sessions court has set aside lower court’s order to summon three police officers and held that a case cannot be filed against them without permission from the government.

Additional District Sessions Judge D C Singh yesterday allowed the plea of the then SP Shamli challenging the order summoning them on a private complaint.

According to prosecution, Chief Judicial Magistrate Narendra Kumar had issued summonses against three police officers including the then SP Abdul Hamid, additional SP Atul Saxena and SHO R N Yadav.

Earlier, a complaint was filed against the three officers alleging that they had beaten up protestors including BJP MLA Hukum Singh, who were demanding the arrest of a gangrape accused in Shamli on June 17, 2013 and held them in illegal custody.
