The Allahabad High Court today stayed the bail order granted by a sessions court here to former Uttar Pradesh minister Gayatri Prajapati in a rape case.

The order was passed by Chief Justice Dilip B Bhosale on an application moved by the state government through Additional Advocate General V K Shahi seeking cancellation of bail granted to Prajapati and two other co-accused in the case.

Shahi submitted that sufficient time was not given by the sessions court to the prosecution for seeking instructions against the accused.

He further contended that in his bail application, Prajapati stated that he had no criminal case pending against him but six cases were pending against him.

“Order of bail of April 25 shall remain in abeyance until further orders. Investigation agency to take other accused in custody, pending the hearing and final disposal of this application,” the Lucknow bench of the high court said.

Prajapati and two of his alleged accomplices were on Tuesday granted bail by special judge of POCSO court Om Prakash Mishra in connection with the rape case that had rocked the state some months ago during the Samajwadi Party rule.

A woman from Chitrakoot had approached Gautampalli police station on February 17 alleging that she was raped by Prajapati and two more men for several months before she alerted the police.

She also alleged that the three had also sexually assaulted her minor daughter at Prajapati’s residence.

UP minister Gayatri Prajapati, who is evading arrest, today failed to get relief from the Supreme Court which expressed unhappiness that its order on lodging of FIR against the SP leader was being given “political colour”.

A bench headed by Justice A K Sikri clarified that it has only ordered the Uttar Pradesh police to lodge an FIR against Prajapati in cases of alleged gangrape and attempt to rape a woman and her daughter and is not monitoring these cases.

The minister can approach the court concerned for appropriate relief, the apex court said while rejecting Prajapati’s plea for recall of its order for lodging an FIR against him.

The apex court had on February 17 directed the UP Police to lodge an FIR against Samajwadi Party (SP) leader Prajapati and asked it to submitt an action taken report regarding the incidents in eight weeks in a sealed cover.

“We have simply directed registration of an FIR and investigation in these cases,” the bench said, adding, “now political colour is being given to this order. It is unfortunate”.

“Let the police investigate this matter and say whatever they want,” the apex court said.

Prajapati, whose opponents have used the issue in electioneering in poll-bound state to attack him and his party, has cried foul alleging that it is a “politically motivated” case as the complainant is affiliated to the BJP.
