Man gets 20 years’ Rigourous Imprisonment for raping minor

A local court Wednesday sentenced a man to 20 years’ rigorous imprisonment (RI) for raping a girl in Mayurbhanj district of Odisha four years ago.

Additional district and sessions judge of Baripada, Dr V Sujata, passed the verdict after finding Bailochan Mohanta guilty of raping the girl.

Mohanta’s two associates, Purusattam Mohanta and Bailochan Behera, were awarded three years’ RI by the judge.

The three had forced the victim to accompany them to a forest on September 11, 2015 where Bailochan Mohanta raped her.

Repeat offender gets 10 years in jail for raping minor

A repeat offender was Monday sentenced to 10 years in jail by a POCSO court here for raping an eight-year-old girl in suburban Vakola area here in 2013.

Aiyaz Ansari (38) was found guilty under section 376 (rape), 363 (kidnapping) and 506 (criminal intimidation) of the Indian Penal Code as well as relevant provisions of the Protection of Children from Sexual Offences (POCSO) Act by Additional Sessions Judge B V Kale.

The judge also fined him Rs 65,000, additional public prosecutor Rakesh Tiwari said.

As per the prosecution, the incident took place on October 14, 2013, in Vakola when the girl was returning her home from school.

Ansari introduced himself to the victim as her father’s friend and took her to a secluded place where he raped her.

During the course of trial, the prosecution examined six witnesses, Tiwari said.

Ansari is a serial offender and has targeted several schoolgirls using the same modus operandi and has about seven POCSO cases registered against his name in police stations here, the additional public prosecutor said.

HC grants bail to engineering student accused of raping minor

 The Delhi High Court today granted bail to an 18-year-old engineering student, accused of raping a minor by befriending her on WhatsApp and then taking her to a park, where he allegedly committed the crime.

Justice A K Pathak granted him the relief subject to furnishing a personal bond of Rs 25,000 with one surety of a like amount.

The court also directed the student not to contact the girl or her family members or influence any witness in the case.

As per the prosecution, the boy first came in touch with the 14-and-a-half year old girl through a social networking site in December last year and on December 29, 2017 took her to a park here and allegedly raped her.

The accused’s lawyer, Vijay Kumar Aggarwal, opposed the charges and contended that while the alleged incident was of December 29, 2017, the FIR was lodged a day later.

He said the girl was medically examined only on January 1, 2018.

“Even in the statement, the prosecutrix has not levelled any allegations of rape or oral sex. In FIR, the girl has simply stated that the petitioner has been conversing with her on WhatsApp and Instagram. She has improved her version at the behest of her father,” Aggarwal submitted.

Additional Public Prosecutor M P Singh, appearing for the Delhi Police, contended that the girl, a minor, was studying in class nine, whereas the accused is 18-years-old and is pursuing B Tech from Manipal University in Jaipur.

“The accused had allured her to a park and raped her,” the counsel for the police argued, adding that the girl was nervous when she returned home on the date of incident and had not disclosed the rape incident to her mother or in the complaint made to the police.

A local court here has sentenced a youth to 10 years in jail for abducting and raping a 15-year-old girl in 2010.

Additional District Judge Manoj Kumar sentenced Naushad, the main convict in the case, to 10 years in jail and imposed a fine of Rs 18,000 on him after holding him guilty.

The court also sentenced two other convicts Nawab and Kauser to five years in jail and imposed a fine of Rs 8,000 each, according to the prosecution.

The victim was abducted by Naushad with the help of the two other convicts and was raped by him in Alipur village in Shamli district on December 13, 2010.

Court acquits youth of charges of raping minor

rapeA youth has been acquitted of the charges of kidnapping and raping a minor after enticing her to marry him by a Delhi court, which said he was not on the wrong side of the law and the girl had voluntarily gone with him.

Additional Sessions Judge Vinod Yadav freed the youth, saying the element of “taking away or enticement was found to be lacking” and it appeared that the girl was a willing and consenting party and “everything had happened with her own sweet will”.

“In these circumstances, the factum of kidnapping of prosecutrix does not stand proved. If the law laid down…is applied to the facts of the present case, then it would be absolutely clear that the accused is not on the wrong side of law in the matter,” the court said.

It noted that both the youth and the girl are now happily married and are parents of a girl.

The court said as per the ossification test, the girl was found to be between 17-18 years of age and at the time of incident, she had, “presumably attained sufficient maturity to decide about her future”.

During the trial, the girl in her statement before the court said that she had voluntarily gone with the accused and was now happily married with him.

She said her family members were against her relationship with the accused and thus lodged a false complaint against him with the police.

The court, while acquitting the Delhi resident of the charges of 363 (kidnapping), 366 (kidnapping with intent to force a woman for marriage or to establish illicit relation) and 376 (rape) of the IPC, said the prosecution has failed to establish the charges against the youth.

According to the prosecution, an FIR was lodged against the accused on July 8, 2013, on the complaint of victim’s father that she has been kidnapped and enticed by the him.

During the trial, the accused pleaded innocence and claimed that he was falsely implicated in the case by the father of the girl. He also said that he and the girl were major at the time of incident.

Man gets lifer in a month for raping minor

In a swift judgement, a man was today sentenced to life imprisonment by a court here for raping a five-year-old girl at Singhaul village in Begusarai district last month.
Begusarai Sessions Judge Parshuram Shukla sentenced Pappu Tanti to life imprisonment and imposed Rs 20,000 as fine on him for raping the minor on April 10.

The victim’s father lodged a case on April 15 following which Tanti was arrested from Kanpur on May 2.

The accused was produced before the Begusarai court on May 3 and chargesheet against him was submitted the very next day.

The court held hearings on a daily basis and pronounced the quantum of punishment this afternoon after holding him guilty yesterday.
