Rajesh and Nupur Talwar, parents of murdered teenager Aarushi Talwar, Monday filed an appeal in the Allahabad High Court against the special Central Bureau of Investigation (CBI) court’s order to put them on trial for their daughter’s killing, their lawyer said in Allahabad.The court will take up the appeal Wednesday, said Samit Gopal, spokesperson for senior lawyer Gopal Chaturvedi who the Talwars have appointed as their counsel in Allahabad.
“We have filed a petition. Now it’s in the court’s hands,” Talwar’s lawyer Rebecca John told in Delhi.
“I would not comment on the merits of the case as the case is subjudice,” John added.
Special Judicial Magistrate Preeti Singh had ordered Feb 9 that the Talwars be charged with murder, destruction of evidence and criminal conspiracy.
“We are definitely taken aback by the order. Nothing can justify the summoning of Rajesh Talwar (for the next hearing Feb 28) but having done it, we will go to a higher court challenging the order,” John had said earlier.
Aarushi, a Class 9 student of Delhi Public School, Noida, was found murdered under mysterious circumstances in her parents’ Jalvayu Vihar Apartment in Noida on May 16, 2008.
Their domestic help Hemraj was initially suspected for the killing, but his body was found on the flat’s terrace a day later.
I find that now people from all walks of life have understood that when a matter is seized by the court , nobody has any right to discuss the matter in public except before the court and with its prior permission. That is called ‘subjudice\. Let the respective courts examine the matter when it comes before them and pass necessary orders. Justice will be done at every point of contest by the courts. let us trust and praise our judiciary for its impeccable integrity and legal professionalism.
