Court dismisses plea against AIIMS doctors & policemen

aiimsA Delhi court has dismissed a plea against doctors and staff of AIIMS along with seven cops for allegedly failing to provide medical aid to two injured persons and beating them, saying no evidence has been found regarding the incident.

Special CBI Judge Sanjeev Jain upheld the trial court’s order, which had dismissed the plea of Kumar Saumitra and Mohit Kukreti, saying that the investigation revealed that they were under the influence of alcohol and had misbehaved with doctors and staff of All India Institute of Medical Sciences (AIIMS).

“The hospital like AIIMS in Delhi is one of the premier medical institutes of India which entertains thousands of patients on daily basis. It is hard to believe that in such a hospital, the injured would not be given medical aid.”

“However, if any such incident would have occurred, there would have been some prima facie evidence in the CCTV coverage but the footage does not suggest so,” the judge said.

In their plea, both Kumar and Mohit had claimed that on the night of August 6-7, 2012, they were injured in a road accident and when they reached AIIMS for treatment, no one attended them.

The plea had alleged that the doctors and staff members were gossiping in a room and when they asked for medical aid, they were beaten up and locked up in a room.

It further claimed that later the duo were handed over to the police and were taken to Safdarjung police station where they were beaten up and their gold chain and lockets were taken away.

The petition had arrayed 12 doctors and staff of AIIMS hospital and seven policemen as accused.

The court, however, rejected their claims, saying, “Prima facie, it appears improbable that the injured would not be given medical aid by doctors and would be given beatings because of their request for medical aid.”

The court also noted that from the material on record, the version of complainants did not inspire any confidence and appeared to be a “counter blast” in response to the FIR lodged against them by the doctors.
