This
is an application for condonation of delay in preferring the first
appeal.

For
the reasons stated in the application, delay in preferring the first
appeal is condoned. Rule is made absolute.

FIRST
APPEAL (STAMP) No. 1296 of 2009

This
appeal is filed under Section
96 of the Code of Civil Procedure, 1908 read with Section 54 of the
Land Acquisition Act, 1894 against the judgment and award dated 11th
May 2007 passed by the Reference Court under Section 18 of the said
Act.

In
this appeal, the claim involved in less than Rs.1 lakh. It has been
consistent practice of this Court not to enter into the merits of
those appeals wherein the claim in appeal is a pretty claim and
claims up to Rs.1,00,000/- have been quantified by this Court as
petty claims.

No
question of law or principle is urged.

This
appeal is, therefore, summarily dismissed without entering into the
merits of the matter on the ground that it represents a petty claim.
It should not, however, be treated as a precedent.
