Heard learned counsel for the petitioner and

learned Additional Public Prosecutor for the State.

Petitioner is named accused in this case being

husband. Initially there was some negotiation between the

parties to settle the dispute but due to some unavoidable

circumstances for the present no settlement is possible. On

behalf of the petitioner, during the course of submissions,

offer is made to pay a sum of Rs.1,500/- (Rupees one

thousand five hundred) per month by way of ad-interim

maintenance to his wife and solitary child subject to any order

by competent authority on the point. He has stated that

during negotiation this matter was also considered and now

enhanced quantum is offered.

However, considering all such aspects, on the

event of filing a petition before the court below stating an

offer to make payment of Rs.1,800/- (Rupees one thousand

eight hundred) per month by way of ad-interim maintenance

subject to final order of the competent court on the point and

begin with the payment, the petitioner, in the event of his

arrest or surrender within four weeks from today, is directed

to be released on bail on his furnishing bonds of Rs.10,000/-

(Rupees ten thousand) with two sureties of the like amount

each to the satisfaction of the Chief Judicial Magistrate,

Buxar, in Buxar town P.S. Case no. 212 of 2009, subject to

the conditions laid down in Section 438(2) of the Code of

Criminal Procedure with additional condition that the

petitioner shall remain present before the court below on each

and every date till disposal of the case. If the petitioner fails

to remain present on two consecutive dates without any

reasonable explanation or make a single default in payment

the privilege granted shall be deemed to be cancelled.

Let the order be communicated to the court

below by FAX on the cost being deposited by the petitioner.
