Background
The relevant excerpt from Para 8 of the above decision is reproduced below.
1. The Commission observed that the Respondents were neither present during the hearing
nor had they submitted any explanation to showcause notice. The Commission therefore
gives one more opportunity to the PIO to provide the explanation as sought in the
showcause notice and also to appear before the Commission on 3 May, 2010 along with
his written submissions failing which action would be taken as per Section 20 of the RTI
Act, 2005.
2. As decided in the Order, the Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing on May 03, 2010.
3. Mr. Brijesh Singh, Director, Mr. Maulee Dharan, SA, represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Respondent submitted that due to some internal inadvertent lapses in coordination
within the office the decision of the Commission did not reach the concerned PIO. Hence, he was
not able to appear for the hearing held on 15.3.10. He also informed the Commission that the
grievance of the Appellant has been redressed since the Complainant has been promoted and
the order for promotion was issued on 21.12.2009.
6. The complaint is accordingly disposed of and the case is closed at the Commission’s
end.
