Heard learned counsel for the petitoner and learned Standing
Counsel.

Petitioner, who is working on the post of Aagan Bari Shayika
claims that in view of the advertisement dated 03.07.2010 as in the
block where the petitioner is working, 42 vacancies have been
declared, therefore, according to the Government order 25% of the
vacancies have to be filled up amongst the candidates, who are
working on the post of Aagan Bari Sahayika having experience of
five years with satisfactory work. Petitioner alleges that she has
completed five years of service and therefore, according to the
Government order, she is entitled to be considered for the post of
Agan Bari Karyakarti in view of the vacancy advertised on
03.07.2010. The petitioner submitted an application to this effect
before the District Magistrate, respondent No.2 but no decision has
been taken. Hence this writ petition.

After considering the submission of learned counsel for the
petitioner, as claim of the petitioner is still pending consideration
and on the basis of the advertisement dated 03.07.2010 no final
selection has been taken, therefore, in my opinion it will be
appropriate that the respondent No.2 may take a decision regarding
promotion of the petitoner on the post of Aagan Bari Karyakarti
taking into the Government order issued by the State Government
according to law, if possible, within a period of six weeks from the
date of production of certified copy of this order.

The writ petition is accordingly, disposed of.

No order as to costs.
