Background
1. The Applicant filed his RTI request on 25.05.09 with the PIO, S E C Railway,
Bilaspur seeking his ACRs besides information about promotion, order on
panel dated 14.5.09 etc. against 5 points and denying copies of ACRs as they
are confidential documents . The PIO replied on 17.06.09 providing point wise
information. Not satisfied with the reply, the Applicant filed his First Appeal on
22.07.09 stating that information has not been provided against points 2 and
for 4 and requesting for the information once again. The Appellate Authority
in his order dated 29.07.09 provided further clarification. Being aggrieved
with the reply, the Applicant filed his Second Appeal before the Commission
requesting again for information against points 2 & 4 of his RTI Application.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing for 8th February, 2010 through video conferencing.
3. Mr.Sakil Hussain, PIO, and Mr. R. Singh, Appellate Authority represented the
Public Authority at NIC studio, Bilaspur.
4. The Appellant was present during the hearing.
Decision
6. The Appellant admitted having received all the information except copies of
ACRs and the Order dated 14.5.09. The Commission allows the appeal and
directs the PIO to provide authenticated copies of ACRs of the Appellant for
the last 5 years to him along with information sought in point 2 of the RTI
application. Information to be provided by 15th March, 2010.
