2. 05.07.2011 The petitioners have preferred this revision
application against the order dated 12.7.2010 passed by
the learned Sessions Judge, Rohtas at Sasaram in
Criminal Misc. No. 28 of 2010 by which it has been held
that Confiscation Proceeding No. 22 of 2009 is pending
before the District Magistrate, Rohtas at Sasaram. In that
view of the matter, the petition for release of fertilizer of
the petitioner filed in the Court of learned SDJM is not
maintainable.
Learned counsel for the petitioners seeks
permission to withdraw this application with liberty to
move the appropriate forum.

This revision petition is, accordingly, dismissed as
withdrawn.
