ORAL ORDER
1Rule. Mr.A.J. Desai, learned A.P.P. appears
and waives service of rule on behalf of the respondent –
State.
2.Heard learned counsel for the applicant and
learned A.P.P. for the respondent – State.
3.The parties do not press for a reasoned order.
Considering the submissions made on behalf of the
parties, and having regard to the facts and circumstances
of the case, the application is allowed and he is ordered
to be released on bail in connection with C.R.
No.I-114/2002 registered at Sardarnagar Police Station
for the offence charged against him in this application
on executing a bond of Rs.10,000/= (Rupees Ten Thousand
only) with one surety of the like amount to the
satisfaction of the lower Court and subject to the
conditions that he shall;
(a) not take undue advantage of liberty or abuse his
liberty;
(b) not try to tamper or pressurize the prosecution
witnesses or complainant in any manner;
(c) maintain law and order and co-operate the
investigating officer;
(d) not act in a manner injurious to the interest of
the prosecution;
(e) furnish the present and permanent address of his
residence to the I.O. and also to the Court at
the time of execution of the bond and shall not
change the residence without prior permission of
this Court;
(f) mark his presence before the nearest Police
Station twice in a month more particularly
between 1st and 15th and 16th to end of each
month between 10.00 a.m. and 2.00 p.m;
(g) not leave the limit of State of Gujarat without
prior permission of the Court;
(h) not enter into the Ahmedabad city except for
attending the Court in connection with this case;
he will be free to enter the limits for a period
to the extent necessary and will leave the limits
thereafter soon after the case is adjourned.
This condition to apply for a period of 6 months
from today; and
(i) surrender his Passport, if any, to the lower
Court within a week;
4.If breach of any of the above conditions is
committed, the Sessions Judge concerned will be free to
issue warrant or take appropriate action in the matter.
5.Bail bonds to be executed before the lower Court
having jurisdiction to try the case.
6.Rule made absolute to the aforesaid extent.
Direct service is permitted.
