O R D E R
The Commission has received a complaint dated 5.9.2011 for non
furnishing of information by CPIO/AA, Ministry of Home Affairs, New Delhi,
to his RTI request dated 25.4.2011 and first appeal dated 17.6.2011
respectively.
2. That from a perusal of the papers submitted by the complainant, it is
prima facie observed that complainant’s RTI request failed to elicit information
either from the CPIO or from the Appellate Authority.
3. In order to avoid multiple proceedings u/s 18 & 19 of the RTI Act, the
PIO is directed to furnish the reply to the complainant to his RTI application
dated 25.4.2011 within two weeks of receipt of this order.
4. If the complainant is not satisfied with the reply received from PIO, he
may within the time prescribed, file his first appeal before the appellate
authority u/s 19(1) of the RTI Act, who shall dispose of the appeal within the
period stipulated in the RTI Act.
5. The complaint is disposed of with above directions.
