Background:
Shri Asgar Khan of Churu filed an RTI-application with the Public
Information Officer, Regional Passport Office, Jaipur, on 11 July 2007, seeking a
photocopy of the Passport application filed by Shri Wahid, S/o Shri Babu Khan,
resident of Ward No. 5, Kumharo Ki Badi, Distt. Bhadra, Hanumangarh,
Rajasthan.
2. The PIO vide his letter dated 10 August 2007, replied to his RTI-
application and denied the information taking recourse to Section 8(1)(j) of the
RTI-Act. Not satisfied with the reply of the PIO, the Appellant filed an appeal
with the first Appellate Authority on 18 August 2007 who vide his letter 14
September 2007 dated replied to his First Appeal. Thereafter, the Appellant
approached the Central Information Commission with a Second Appeal on 28
January 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on 6 August 2008.
4. Shri Shrawan Kumar Verma, Passport Officer & PIO and Shri Prashant
Kumar Jha, JHT, represented the Respondents.
5. The Appellant, Shri Asgar Khan, was present in person.
Decision:
6. The Commission heard both the sides and noted that the Appellant
wanted purely personal information like details of ration card, educational
qualifications, etc. contained in the Affidavit filed by another person while
applying for a Passport. The Respondents denied this information under 8(i)(j)
of the RTI-Act. During the hearing, the Appellant stated that it was necessary
for him to get this information in the case of a family dispute. However, the
Commission agrees with the submission of the Respondents and dismisses the
case.
