Notice
to the respondents returnable today. Ms.Archana Raval appears for and
waives service of notice on behalf of the respondents.
It
is the grievance of the petitioners that their lands were acquired by
the respondents under the Land Acquisition Act (hereinafter referred
to as `the Act’). Some of the other persons whose land was also
acquired had preferred a reference under Section 18 of the Act. The
said reference was decided on 12th January, 2001. The
petitioners who had not applied for reference under Section 18 of the
Act have approached the respondent no.2 under Section 28-A of the Act
for enhancement of the compensation. The application was made in the
month of February, 2001 which is yet not decided.
The
respondent no.2 will decide the pending applications made by the
petitioners under Section 28-A of the Act as expeditiously as
possible preferably within six months from today.
Subject
to the above direction, this petition is disposed of. Notice is
discharged.
The
registry will send the writ forthwith.
