Heard
learned advocate Mr. Acharya, appearing on behalf of petitioner.

In
present petition, petitioner has challenged decision taken by
respondent dated 4th January,2010, wherein it is mentioned
that the petitioner is overage on 4th November,2009 and
has crossed the age of 40 years. Therefore, his case for Helper
Sahayak has not been considered and no appointment order has been
issued in favour of petitioner. Learned advocate Mr. Acharya brought
to the notice of this Court the circular dated 27th
February,2004, wherein under such circumstances, further 38 months
relaxation in the upper age has been given to such candidates those
who have completed training with respondent-Board. It is necessary
to note that after decision dated 4th January,2010,
petitioner remained inactive and not make any representation to
respondent for considering aforesaid circular dated 27th
February,2004. Therefore, let petitioner may make detailed
representation claiming relaxation in overage for the post of Helper
Sahayak as per circular dated 27th February,2004 within a
period of one month from the date of receiving copy of present order.
As and when respondent receive such representation from petitioner,
it is directed to respondent to consider and examine the grievance of
the present petitioner in light of circular dated 27th
February,2004 within a period of three months from the date of
receiving such representation from the petitioner and communicate
decision immediately to petitioner.

In
view of above observations and directions, present petition is
disposed of by this Court without expressing any opinion on merits.
Direct service is permitted.
