Heard learned counsel for the applicant and learned A.G.A. for the State.
Bail has been sought in present case in case crime No. 92 of 2009 under
section 392 IPC of P.S. New Agra, District Agra, in which the applicant is not
named in the FIR.
The submission made by the learned counsel for the applicant is that the
applicant was not apprehended on the spot in the alleged incident of case
crime No. 92 of 2009 and after apprehending from his house, he has been
falsely implicated in the aforesaid case with other accused.
Further submission made by the learned counsel for the applicant is that for
the offence about the recovery of golden chain etc. from the possession of the
applicant, he has been granted bail by the another Bench of this Court vide
order dated 6.1.2010 passed in criminal misc. bail application No. 321 of
2010.
From the FIR (Annexure-1) of case crime No. 92 of 2009, it is revealed that
unknown persons had committed robbery in the house of the complainant. and
no body was named in the FIR.
Having considered all the facts and circumstances of the case, without
expressing any opinion about merit of the case, the applicant may be released
on bail.
Let the applicant- Pawan, be released on bail in case crime No. 92 of 2009
under section 392 IPC, P.S. New Agra, District Agra on his executing a
personal bond of Rs. 25,000/- and furnishing two sureties each in the like
amount to the satisfaction of the Court concerned.
