1 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR O R D E R
S.B. CIVIL WRIT PETITION NO.1481/2009
(Smt. Mumtaj Bano Vs. State & Ors.)
Date of order : 02.03.2009
P R E S E N T
HON’BLE MR. JUSTICE GOPAL KRISHAN VYAS
Mr. Sunil Joshi, for the petitioner.
Heard learned counsel for the petitioner.
This writ petition has been filed by the
petitioner, who is complainant in the FIR No.360/08
dated 18.12.2008 which has been registered for offence
under Sections 498-A, 406 and 323 I.P.C.
The grievance of the petitioner is that after
registration of the case till today there is no
progress in the investigation, therefore, it is prayed
that directions may be issued to the respondents for
investigating the matter properly and to take
appropriate action against the culprits.
Admittedly, FIR was registered at Police
Station Makrana on the basis of the complaint made by
the petitioner under Section 156 (3) Cr.P.C.
Obviously, the investigation is going on but
2
apprehension of the petitioner is that Officer
Incharge of Police Station Makrana is not taking any
action, so also not investigating the matter properly.
In this view of the matter without
interfering with the matter under Article 226 of the
Constitution of India, I deem it just and proper to
grant an opportunity to the petitioner to file a fresh
representation before the Superintendent of Police,
Nagaur. Upon filing the said representation, it is
expected from the Superintendent of Police, Nagaur
that he will take care of the grievance of the
petitioner and will take proper measures for thorough
investigation of the case.
With the aforesaid observation/direction,
this writ petition is disposed of.
