Counsel for the petitioner submits that pursuant to order
dated 2-1-2009, the petitioner has joined the investigation and is no
longer required for further interrogation. He further contends that the
petitioner is not named in the FIR and the main injury on the person
of Harjit Singh has not been attributed to him.
Counsel for the State (on instructions from ASI Raj
Kumar, who is present in Court) does not dispute this legal position.
Keeping in view the totality of facts and circumstances of
the case, I am of the view that the petitioner deserves the
concession of anticipatory bail. Consequently the present petition is
allowed and the interim order dated 2-1-2009 is hereby made
absolute.
