Sumedha Batra Vs DDA dated 17.7.2009
The Decision dated 09/03/2009 of this Commission in this matter may be recalled
wherein Shri S.P. Batra was advised to move the DDA for substitution of his name in
place of her mother Smt. Shakuntala Devi as a Registrant for MIG 1981 Scheme. A
non-compliance pettion dated 19/06/2008 was received from Appellant Smt. Sumedha
Batra against the DDA whereupon Show Cause notice was issued to Shri Anil Kumar,
Deputy Director (LSB)(Resi.) to appear before the Commission on 17/07/2009. In
compliance thereof, Shri Anil Kumar appeared before the Commission. Shri S.P. Batra,
son of the Appellant, is also present. Shri Anil Kumar would submit that Shri S.P. Batra
has not filed a petition for the substitution of his own name but has filed a petition in the
name of his wife. According to him, there are legal difficulties in this and, therefore, he
again suggests that Shri S.P. Batra may file a fresh petition for substitution of his own
name for enabling DDA to process the matter further. Once he does that, then legal
advice will be taken and the matter decided one way or the other.
DECISION
2. In view of the above. Shri S.P. Batra is hereby directed to take action as indicated
above, if he is so advised. Shri Anil Kumar, Deputy Director(LSB)(Resi.) would take
prompt follow up action thereon.
3. The matter stands closed at the Commission’s end.
