2 14-10-2011 Heard.

The petitioners apprehend their arrest in a criminal

prosecution registered under Section 307/34 and some allied

offences under the Indian Penal Code.

Learned counsel for the petitioners submits that for the

same occurrence, there is a case and counter case vide Annexures-

1 and 3 respectively. It is submitted that as a matter of fact the

present case is a counter blast of the case lodged earlier from the

side of the petitioners by co-accused Lalan Yadav vide Annexure-

3. It is also submitted that both sides have sustained injuries on

their person. It is further submitted that members of prosecution

party are already on bail in the case lodged from the side of the

petitioners vide Annexure-3.

In the aforesaid facts and circumstances, in the event of

their arrest or surrender before the learned court below within a

period of four weeks from today, the above named petitioners are

directed to be released on bail, on furnishing bail bond of

Rs.10,000/-(ten thousand) each with two sureties of like amount

each in connection with Bairiya P.S. Case No. 177 of 2010 to the

satisfaction of learned Chief Judicial Magistrate, Bettiah, West

Champaran, subject to the conditions laid down under Section 438

(2) of the Cr.P.C.
