ORDER

1. This
petition, under Article 226 of the Constitution of India, has been
filed with the following prayers:

“A) issue
an appropriate writ, order or direction to the respondent to allow
the petitioner to submit the requisite creamy layer certificate for
the advertisement given by the respondent for the post of Assistant
Conservator of Forest, Class-II/Range Forest Officer, Class-II;

B) Issue
appropriate writ, order or direction to the respondent to allow the
petitioner to appear in the main written examination which is to be
held between 19/02/2011 to 03/03/2011 for the post of Assistant
Conservator of Forest, Class-II/Range Forest Officer, Class-II;

C) Pending
admission and/or final disposal of this petition, the respondent be
directed to allow the petitioner to appear in the main written
examination which is to be held between 19/02/2011 to 03/03/2011 for
the post of Assistant Conservator of Forest, Class-II/Range Forest
Officer, Class-II;

D) pending
admission and/or final disposal of this petition, further procedure
with respect to the advertisement by the GPSC for the post of
Assistant Conservator of Forest, Class-II/Range Forest Officer,
Class-II be stayed”

2. Mr.Rushabh
R. Shah, learned advocate for the petitioner, states that the
interest of justice would be served if the respondent-Gujarat Public
Service Commission is directed to consider and decide the
representation dated 02.02.2011 made by the petitioner
expeditiously and before the commencement of the final examination.

3. Upon
the above submission being made by the learned advocate for the
petitioner, the following order is passed.

4. The
respondent-Gujarat Public Service Commission is directed to consider
and decide the representation dated 02.02.2011 (Annexure-G) made by
the petitioner on or before 15.02.2011.

5. It
is clarified that while passing this order the court has not entered
into the merits of the matter.

6. The
petition is disposed of accordingly. Direct service is permitted.
