Learned counsel for the petitioner prays for and

is granted two weeks time for filing supplementary affidavit

in I.A. No. 8370 of 2010 disclosing the date of death of

opposite party no.3 failing which this application, as

against him, shall stand rejected without further reference

to a Bench.

Learned counsel for the petitioner further

submits that a copy of the aforesaid interlocutory

application has already been served upon the other side.
