Background
1. The Appellant filed an RTI request dt.19.06.08 with the CPIO, Haryana
Telecom Circle, Ambala. He requested for information against five
points including names of both the AOs responsible for the irregularity
because of which recovery was effected from his salary on account of
TA bills furnished by the Appellant, along with the addresses for
correspondence. The CPIO replied on 18.7.08 stating that the
information sought is personal and is exempted from disclosure under
Section 8(i)(j) of the RTI Act. Not satisfied with the reply, the
Appellant filed a complaint to CIC on 5.8.08.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing on January 15, 2009.
3. Mr. V.K. Gupta, CPIO present as Public Authority.
4. The Appellant was present at the hearing.
Decision
5. The Respondents submitted that this case was heard earlier by the
Commission and an Order was passed and that the AOs committed a
procedural mistake inadvertently and later the office rectified the
mistake by recovering the amount from the Appellant’s salary. They
also stated that the two AOs were reprimanded for this and warned
never to commit such mistakes again. The Commissioner inspected the
letters written to the two AOs by the Public Authority and noted that
both the AOs were admonished for having committed procedural
mistakes and also warned that while a lenient view is being taken
since it is the first time that they had committed such a mistake, such
mistakes should never be repeated. The Appellant stated that he too
had seen the two letters and had noted their contents but wants the
Public Authority to officially provide him the two names in writing .
6. With regard to disclosure of names and other details of the two AOs,
the Commission exempts such disclosure under Section 8(1)(g) of the
RTI Act.
7. The appeal is accordingly rejected.
