FACTS
:
The appellant has sought information under RTI Act by his letter dated 26.9.2006
addressed to the CPIO, Ministry of Health & Family Welfare, New Delhi requesting
information regarding certain discrepancy in pension papers in respect of the services
rendered by him in Safdarjung Hospital before coming to CGHS. As per Government of
India rules his past service should be taken into account. He has filed this application
before the Ministry of Health and Family Welfare and the CPIO of the Ministry has given
his reply vide letter dated 5.12.2007 by which he informed the appellant since he has not
made such request to take past service into account CGHS has not taken this into account
and he has advised him to take up the matter with CGHS. Accordingly he has taken up
the matter with CGHS on 14.02.2007 for which CGHS has given reply since the
appellant is already getting maximum pension in the service he has rendered in CGHS
itself he is not going to get any additional benefit in adding the past service. They have
also not given suitable reply regarding his status at the time of retirement since he retired
at the level of Sr. Physiotherapist whereas he was shown as only Physiotherapist. Since
the appellant is aggrieved with the said decision he has taken up the matter with the
Commission and the Commission has called for hearing on 11.7.2008, which was
attended by the appellant in person and Deputy Secretary-cum-CPIO of Ministry of
Health and Family Welfare.
DECISION:
2. I have gone through the RTI application as well as replies received in this
connection. The appellant has requested only that his past service rendered in Safdarjung

Hospital be taken into account in his total service and his designation should be shown as
Senior Physiotherapist. The Ministry of Health and Family Welfare did not have any
objection though it has to be done by the CGHS. He was advised to take up the matter in
a specific manner with CGHS and in case if he takes up with the CGHS, CGHS is
directed to give a suitable reply within 15 days from the date of such specific request
from the appellant. For this purpose a copy of this decision is also endorsed to the CPIO
of CGHS as well as Director, CGHS.
On the above lines the appeal is disposed of.
Let a copy of this decision be sent to the appellant and CPIO.
