Sri A.C. Mishra, learned Standing Counsel has filed a counter affidavit of
B.L.Tripathi, Assistant Regional Transport Officer (Admin.), Azamgarh.
From perusal of the affidavit in particular paragraph 11 the liability of the
applicant with regard to the tax and additional tax for the period 1.7.2006 till
31.3.2010 comes to Rs.1,41,028/-. The applicnat has admittedly deposited as
per paragraph 12 of the affidavit an amount of Rs.1,08,245/- during the
aforesaid period. Thus, there is still a deficit of more than Rs.30,000/-
approximately. In case the applicant deposits a sum of Rs.35,000/- which
would be the amount due as per the interim order of the writ court, with the
Assistant Regional Transport Officer (Admin.), Azamgarh within a period of
one week from today the said authority will ensure that interim order of the
writ court is complied with forthwith and the vehicle is released within a
further period of one week.
List this case on 28.7.2010. It would be open to the parties to file status
affidavit on the said date.
