Facts
arising from the Complaint:
Mr. Donesh Bajaj had filed a RTI application with the PIO – MCD, GNCTD,
Assistant Commissioner, West Zone, Rajouri Garden, New Delhi-110027 on 22/05/2008
asking for certain information. Since no reply was received within the mandated time of
30 days, he had filed a complaint under Section 18 to the Commission on 14/07/2009.
The Commission issued a notice to the PIO on 17/07/2009 asking him to supply
the information by 11/08/2009 and sought an explanation for not furnishing the
information within the mandated time. The PIO- MCD, GNCTD, Suptdg. Engineer-I,
West Zone, New Delhi has informed the Commission vide a letter dated 28/07/2009 that
the information pertaining to his Department has been sent to the Complainant on
21/07/2009 and the RTI Application filed by the Complainant has transferred to the PIO-
Horticulture Deptt., West Zone, New Delhi for the remaining information.
Further the PIO- Horticulture Deptt., West Zone, New Delhi has informed the
Commission vide letter dated 04/08/2009 that the requisite information has been supplied
to the Complainant on 04/08/2009.
Decision:
The Complaint is disposed off.
The Commission warns the PIO to ensure that information is given to applicants
within 30 days as mandated under Section 7 (1) of the RTI Act.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act,
2005.
