Application is allowed subject to all just exceptions.

Learned counsel appearing on behalf of the respondents has

stated that in compliance of the order passed by this Court, speaking order

dated 16.12.2008 was passed by the respondents and moreover, whatever

was due according to them, has been paid to the petitioner and thus, the

order passed by this Court has been fully complied with.

However, learned counsel for the petitioner disputes the

aforesaid stand taken by the learned counsel for the respondents and

submits that according to him, the full payment has not been made.

Be that as it may, admittedly, in compliance of the order

passed by this Court, a speaking order has been passed by the

respondents and some of the amount has been paid to him, therefore, I am

not inclined to proceed further in this contempt petition. Even otherwise,

vide judgment dated 21.8.2008, this Court had observed that whatever

dues are found outstanding, shall be paid to the petitioner and if the

petitioner is still aggrieved, he shall be at liberty to seek his remedy in

accordance with law. Thus, the petitioner shall be at liberty to seek any

other appropriate remedy in accordance with law for the alleged balance of

dues.

Rule discharged.
