(Per : HONOURABLE THE CHIEF JUSTICE)

6. 24.09.2010. Both the learned Advocates agree that there is an
error in mention of CWJC No. 3461 of 2010 in our order
dated 17.09.2010.

We, therefore, recall our order dated 17.09.2010
and make a fresh order as under:-

“Admit.
To be heard with CWJC No. 18122 of 2008.

To be notified after Civil Appeal No. 3453 of
2002 pending before the Hon’ble Supreme Court is
decided.

Pending the petition, there shall not be
coercive recovery pursuant to the Demand Notice dated
20.02.2010 (Annexure 5/A to the petition).

In view of the above order, Interlocutory

Application No. 8139 of 2010 stands disposed of.”
