respondents No.1 to 4.

Heard on the question of admission.

In   the   instant   writ   petition   filed   as   public   interest 
litigation short grievance of the petitioner is that the Collector, 
Harda,   respondent   No.2,   has   allotted   10.117   hectares   of   land 
situated   at   Khasra   No.3/4   at  Village,   Adgaonkala   within   the 
Municipal   Council,   Harda   for   collection   of   garbage   of   Harda 
Town in anticipation of approval from the State Government. 
Learned counsel for the petitioner submitted that the said plot 
is adjacent to `Abadi’ of the Village, Adgaonkala and, therefore, 
if the garbage is directed to be dumped there, that would bound 
to result into nuisance, serious diseases and health hazards to 
the   villagers   at   large.     Therefore,   the   respondents   may   be 
restrained from allotting the land in question for the purpose of 
garbage dumping.   Learned counsel for the petitioner further 
submitted   that   in   this   regard   objections,   contained   in 
Annexure­P/13   and   P/14,     have   been   filed   before   the 
respondent No.2 but the same have not yet been decided.

On the other hand, the learned Govt. Advocate drew our 
attention to the report submitted by Naib Tahsildar, Handiya, 
District,   Harda,   respondent   No.7   and   pointed   out   with 
reference to para 2 of the report that objections were invited 
and   since   nobody   filed   any   objection,   therefore,   he 
recommended   for   allotment   of   the   land   in   question   for   the 
aforesaid   purpose.     However,   learned   counsel   for   the 
petitioners submitted that they have no knowledge about the 
said decision.   Besides that, the aforesaid document does not 
indicate the mode of advertisement.

Be that as it may.  We dispose of this petition at this stage 
with the direction to the Collector, Harda, respondent No.2 to 
examine   the   grievance   of   the   petitioner   and   dispose   of   the 
objections   filed   on   behalf   of   the   petitioners,   contained   in 
Annexures­P/13 and P/14 after conducting necessary enquiry, 
by a speaking order expeditiously, preferably within a period of 
three weeks from the date of production of certified copy of this 
order.

With the aforesaid direction, the writ petition is disposed 
of.
