Learned counsel for the parties are united in

submission that an identical matter as involved in the present

writ petition was subject matter of C.W.J.C. No. 3876 of 2010

and which was allowed on 08.09.2010 in favour of the writ

petitioners.

Learned counsel submits that the N.T.P.C. has

preferred an L.P.A. against the judgment and order of the

learned Single Judge giving rise to L.P.A. No. 1878 of 2010 and

which is pending consideration before the Division Bench.

In that view of the matter, put up this case after

disposal of L.P.A. No. 1878 of 2010.
