Heard learned counsel for the petitioner.
No notice is being issued to respondent nos. 2, 3 and 4 in view of
the order being passed.
The only prayer pressed by the petitioner in this writ petition is to
direct the Civil Judge (Junior Division) Court No. 19, Gorakhpur
to decide the Suit No. 312/2000 (Girja Shankar and Others vs.
Basant and Others).
A suit has been filed by the petitioner seeking injunction
restraining defendant from creating nuisance by operating
generator for operating printing press.
It is contended that several applications for amendemnt have been
moved by the defendant which have been allowed by the court and
case is already proceeding for cross examination of the plaintiff.
Looking to the nature of the dispute, we dispose of the writ
petition with the direction that the Trial Court shall endeavor to
dispose of the suit expeditiously.
The writ petition is disposed of as above.
