It is stated by learned counsel for the petitioners that pursuant to
the judgment and order dated 26th August, 2009 passed in Writ
Petition No. 11074 of 2008 inquiry regarding the valid teachers in
the Institution is going on in which the Committee of Management
of the Institution has to place the records.
It is submitted by learned counsel for the petitioners that petitioner
No. 2 may be permitted to place the records so that the correct
facts may be placed in the inquiry. Petitioner No. 2 may place the
records pertaining to inquiry but this will not confer any right upon
the petitioner to claim that the Court has approved him as a validly
elected Manager of the Committee of Management.
Learned Standing Counsel appears for respondent Nos. 1, 2, 3 and
5. Issue notice to respondent No. 4 by Registered Post. Steps may
be taken within a week. The respondents may file a counter
affidavit within three weeks. Rejoinder affidavit, if any, may be
filed within a week thereafter.
