Facts
The background of the matter is that the appellant had negotiated with Shri
Duni Chand r/o H.No. 541, Village-Darai, Union Territory of Chandigarh, the
purchase of latter’s house for Rs. 3,90,000/- and had made an advance of Rs.
60,000/- in this regard. The appellant had lodged a complaint with the Chandigarh
Police alleging that Shri Duni Chand had fraudulently gone back on his word but the
complaint was closed by the police. It is in this context that by his letter of
22.5.2008, the appellant had sought information on 10 points.
2. The CPIO had responded to him through his letter dated 17.7.2008. On
appeal, the Appellate Authority had disposed of the matter vide order dated
13.8.2008.
3. The present appeal is directed against the order of the CPIO/AA.
4. The matter was heard on 19.2.2009. The appellant appeared before the
Commission. The public authority is represented by the officer named above. It is
the submission of the appellant that he was ready to purchase the said house and,
had, infact, got a draft made for Rs. 3,30,000/- as a consideration for the house in
question but when he went to the Tehsildar’s Office he was informed by Tehsildar
that Shri Duni Chand was not legally entitled to sell this house. Due to this reason,
the deal fell through and he lost Rs. 60,000/- advanced to Shri Duni Chand. It is also
his submission that inquiry conducted into his complaint by ASI Sohan Lal is an eye-
wash and that if inquiry had been properly conducted, then an FIR would have been
a logical outcome against Shri Duni Chand.
5. It is the submission of Shri Chadhha that as per available records, the inquiry
has been conducted on the correct lines but he has no objection to conducting a fresh
inquiry into the matter if the Commission so directs.
DECISION
5. Whether or not the inquiry has been conducted properly, it is not for the
Commission to determine. As the appellant has strongly pleaded that inquiry has not
been conducted properly, it would be fit and proper to direct Shri B.S. Chaddha, DSP
to conduct a fresh inquiry at his own level and decide the same on merits.
6. The matter is disposed of subject to the above directions.
