Not satisfied with the response provided by the PIO.
Order of the First Appellate Authority (FAA):
Reiterated the stand of the Public Information Officer on all material points. Information denied under
section 8 (1)(d) of the RTI Act.
Grounds for the Second Appeal:
Not satisfied with the order of the First Appellate Authority.
Relevant Facts emerging during Hearing:
The following were present
Appellant: Smt. Ananthlakshmi on video conference from NIC-Sysore Studio;
Respondent: Mr. U. P. Prabhu, PIO & Dy. Zonal Manager on video conference from NIC-Bengaluru;
The PIO has refused to provide information on query-3 & 4 which are basically file notings. This
refusal to provide the information has no basis in law and the PIO is warned that if any denial of
information is made it should be as per the provisions of Section 8(1) of the RTI Act. The PIO is directed
to provide the information on queries 3 & 4 to the Appellant before 26 September 2011. The Appellant
would like to inspect the relevant records with respect to other queries on 10/10/2011.
Decision:
The Appeal is allowed.
The PIO is directed to facilitate an inspection of the relevant records on 10 October
2011 from 10.30AM onwards. The PIO will give attested copies of records which the
Appellant wants free of cost upto 200 pages.
This decision is announced in open chamber.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.
