Issue notice to the respondents by Registered Post (A/D) within a fortnight
returnable within six weeks. Send for lower Court records.
The appeal will be finally heard and decided on the date fixed by the office after six
weeks.
In case the appellant deposits the entire amount awarded by Motor Accident Claim
Tribunal, Shahjahanpur in M.A.C.P. No.121 of 2008 along with interest accrued
thereon till date within a period of one month from today, further execution of the
impugned award shall remain stayed. The Tribunal concerned is directed to release
50 % (fifty percent) of the total deposited amount to the claimant/s without security.
However, the Tribunal concerned is at liberty to keep remaining/balance 50 % of
the total deposited amount in a short term Fixed Deposit in a Nationalized Bank and
will be renewed from time to time till the payment is made or till further order/s of the
Court, whichever is applicable. It is made clear that the entire deposited amount will
include the statutory deposit of Rs.25,000/- (twenty five thousand), which will be
remitted in favour of the concerned Tribunal as expeditiously as possible.
List immediately after expiry of the aforesaid period.
