The grievance of the petitioner before this court is that despite
the directions issued by this Court dated 6.2.2009, respondent No.1 has
failed to consider and decide the representation of the petitioner in
accordance with law.
I have heard learned counsel for the petitioner.
As per the averments made in this petition, the entries in his
favour were changed by the respondents maliciously and the same were
detected in an inquiry. Farad Badar was also prepared but no action was
taken against the revenue staff for their fraudulent action and, thus, the
respondents are guilty of committing the contempt of this court.
Admittedly, the civil suit is pending between the parties with
regard to their rights in the land in dispute. The scope of Farad Badar is to
make correction in the revenue record. Moreover, a specific statutory
remedy for making correction in the revenue record is available under the
provisions of the Punjab Land Revenue Act.
Thus, I am not inclined to take cognizance of this petition at
this stage.
