In these two writ petitions, the petitioners are financiers of

vehicles purchased by the 2nd respondent in each writ petition. On

account of default in payment of the hire purchase amounts, the

petitioners repossessed the vehicles. They have now sought

registration of the vehicles in their names. The 1st respondent is not

considering the petitioners’ application for registration of the vehicles

in their names, is the complaint in these writ petitions. The

petitioners now seek a direction to the 1st respondent to consider and

pass orders on their applications for registration of vehicles in their

names, after affording an opportunity of being heard to the petitioners

as well as the purchasers.

2. I have the learned Government Pleader also.

In the facts and circumstances of the case, I dispose of these

writ petitions with a direction to the 1st respondent to consider and

pass orders on the applications for registration of the vehicles in the

respective petitioner’s name, after affording an opportunity of being

heard to the petitioners as well as the purchasers as expeditiously as

possible, at any rate, within one month from the date of receipt of a

copy of this judgment. It would be open for the petitioners to

request registration on the basis of the duplicate copies of the

documents, originals of which are in the possession of the purchasers

and the 1st respondent shall consider that claim also in accordance

with law, after hearing the purchasers.
