Heard learned counsel for the parties.

The petitioner seeks regular bail in a case registered against her

for the offence under Section 306 IPC.

The FIR has been registered on the statement of Lakhwinder

Singh, who stated that on 25.6.2008 he along with his father Puran Singh

(deceased) were working in their fields. Then his aunt (father’s younger

brother’s wife), namely, Kulwinder Kaur (petitioner) came to the tube-well

at about 10.00 a.m. and abused Puran Singh. She asked him to give turn of

the water first from the tube-well. She pulled the hair and beard of Puran

Singh. Besides, she assaulted and grappled with him. Puran Singh felt

disrespected and aggrieved from the petitioner and he consumed intoxicant

tablets which were kept in the room of the tube-well due to anger. When he

came out of the room he started vomiting. Sukhwinder Kaur-mother of the

complainant came to the tube-well. On seeing her, Kulwinder Kaur

(petitioner) ran away from the spot.

The question whether the petitioner abetted the suicide of Puran

Singh is to be considered and gone into after evidence has been led by the

prosecution. At this stage, it cannot be said that the petitioner indeed had

abetted commission of suicide by Puran Singh (deceased).

In the circumstances, without going into the merits of the

controversy, the petitioner on her furnishing personal bond and surety to the

satisfaction of the learned Chief Judicial Magistrate, Gurdaspur shall be

admitted to bail.
