Background
1. The Applicant filed an RTI application dt.13.3.08 with the CPIO, DoP, New
Delhi. He stated that a reminder dt.18.2.08 was addressed to CPMG, Bihar
Circle, Patna with a copy to Secy, DoP, New Delhi. He wanted to know what
action has been taken with regard to his reminder letter dt.18.2.08. The
CPIO replied on 17.4.08 stating that his revision petition dt.25.5.07 was
already disposed off by the competent authority under the office memo
dt.3.10.07, a copy of which was sent to the Applicant. Not satisfied with the
reply, the Applicant filed an appeal dt.18.5.08 with the Appellate Authority
reiterating his request for the information. On not receiving any reply, he
filed a second appeal dt.15.2.09 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for April 27, 2009.
3. The Public Authority was absent at the hearing. The Commission takes a
serious view of the fact that neither the CPIO nor Appellate Authority turned
up for the hearing.
4. The Applicant was present during the hearing.
Decision
5. The Commission observed that the information provided by the CPIO has no
relation to the information sought by the Appellant regarding his recall
application and the reminder on action taken on it. Accordingly, the CPIO,
Patna is directed to provide the relevant information to the Appellant within
20 days of the date of issue of this Order.
6. The appeal is disposed off.
