Affidavit-in-reply
with annexures tendered today by ld. Counsel Mr. Dharmesh Shah for
the respondent No.2 Bank, is taken on record.

During
the course of discussion that has taken place today while hearing
Cri.Misc. Application No. 6763/2004, the Court is of the view that
let both these Cri.Misc. Applications may receive consideration by
some other Bench. So, not before this Bench. Registry is directed to
place this matter at the earliest before the Hon’ble Chief Justice
for obtaining appropriate orders for placing these matters before
another Bench. Since the interim relief granted earlier expires
today, the Registry shall see that both these matters are listed
before another Bench at the earliest and preferably tomorrow or at
least on Monday i.e. on 09.10.2006. So, till that period, interim
relief/protection granted shall be treated as extended.
