       This petition is directed against an order dated 9.9.2010 by
I Civil Judge Class-II, Panna in Civil Suit No.51-A/2009 by which
an application filed by the respondent/ State under Order 9 Rule 7

C.P.C was allowed and the State was permitted to participate in
the suit after setting aside ex parte order.

Though there is some substance in the prayer made by the
petitioner but when the trial Court has exercised its discretion in
allowing the application under Order 9 Rule 7 C.P.C, we are not
inclined to interfere in the impugned order. The petition is
dismissed with no order as to cost.
