Heard learned counsel for the applicant, learned A.G.A. for the State and
perused the record.
Learned counsel for the applicant has contended that FIR has been lodged
against the applicant on the basis of suspicion and thereafter I.O. has recorded
statement of witness Brahm Singh who has given last seen evidence against
the applicant and there is no direct evidence to connect him with murder of
the deceased. The applicant is in jail since 1.5.2010.
Learned A.G.A. has contended that the deceased was taken away by the
applicant and other co-accused and thereafter dead body was found.
Suspicion has been shown against the applicant. There is last seen
evidence. No recovery of any incriminating article has been made from
possession of the applicant.
Considering the nature of accusation and the severity of punishment in case of
conviction and the nature of supporting evidence, reasonable apprehension of
tampering of the witnesses and prima facie satisfaction of the court in support
of the charge, the applicant is entitled to be released on bail.
Let the applicant Sonu involved in case crime no. 321 of 2010, under
section 147, 148, 149, 364, 302, 201 IPC, P.S. Baghpat, District Baghpat be
released on bail on his furnishing a personal bond with two sureties each in
the like amount to the satisfaction of the court concerned.
