FACTS
:
The matter is called for hearing today dated 2.2.2010. Appellant
present. MES is represented by Shri Anil Kumar. Parties are heard. It is
noticed that the information requested for by the appellant vide his RTI
application dated 4.4.2009 was furnished to him on 30.7.2009, that is, after
a gap of about 03 months. It is the appellant’s submission that information
should have been provided to him in one month time but it was provided
after three months and thereby the CPIO has violated the provision of RTI
Act and is liable for penal action u/s 20 (1) of the RTI Act.
2. Shri Bansal, however, has not appeared and authorised Shri Anil
Kumar to appear before the Commission. Shri Anil Kumar submits a copy
of the representation dated 31.1.2010 sent by Shri Bansal in para 02
whereof he has mentioned that appellant had visited his office on 6.4.2009
and the SOP was shown to him. The appellant, however, denies to have
been shown the SOP.
INTERIM DECISION
3. Notice may be issued to Shri R.K. Bansal, Superintendent Engineer,
Cdr Works Engineer, Jalandhar Cantt., to show-cause why penal action
should not be taken against him u/s 20 (1) of the RTI Act for delayed
supply of information to the appellant.
4. The matter is adjourned to 10.3.2010 at 1250 hrs.
