It is not disputed that trial is near conclusion as after recording of
prosecution evidence, the case is now fixed for 12.9.2009 for recording of
statement under Section 313 Cr.P.C.

Considering the aforesaid facts and also that the FIR is under Section
302 IPC, the trial court is directed to expedite the disposal thereof.

The petition stands disposed of.
