It is submitted by the appellant that the defaults as
pointed out by the office have been made good. It is further
submitted that the appellant shall be filing an application
seeking condonation of delay in filing appeal within 3 working
days.
Prayer allowed.
At this stage, it is submitted by the appellant that the
respondents are affecting the recovery by detention of goods.
Earlier in W.P.2296/2010, there was an ad interim writ and
because of that no action was taken by the respondents. It is
submitted that till the admission of this appeal recovery against
the appellant may be stayed.
Prayer made by the appellant is opposed by the other
side.
Considering aforesaid, we direct that this appeal be listed
for hearing on admission on 8.12.2010.
Till next date of hearing, it is directed that in case
appellant deposits Rs.5 Lakhs with the respondents within a
week then the recovery of remaining amount from the appellant
shall remain stayed.
