2. 8.11.2011. Heard learned counsel for the petitioner and learned

counsel for the State.

The petitioner seeks bail in a case registered for the

offence punishable under sections 341, 323, 324, 307 and 504/34 of

Indian Penal Code and section 27 of the Arms Act. Later on, in course

of investigation section 302 of the Indian Penal Code was added.

It is submitted that specific allegation of firing is against

Satendra Singh, Harigovind Singh and Binod Singh. According to the

first information report the petitioner and some other co-accused

persons came after the aforesaid three accused persons had already

opened fire and caused injury on the person of brother of the nephew

of the informant. Similarly circumstanced co-accused Upendra Kumar

and Sikandar Singh @ Kantu Singh have been granted bail by order

dated 13.6.2011 passed in Cr.Misc. No.16633 of 2011 by another

Bench of this court.

Considering the aforesaid submissions and facts and

circumstances of the case petitioner, namely, Mukendra Bind, who is

in custody since 13.7.2011, is directed to be released on bail on

furnishing bail bonds of Rs.10,000/- with two sureties of the like

amount each to the satisfaction of learned S.D.J.M., Daudnagar in

connection with Haspura P.S.Case No.35 of 2011.
