Heard on IA No.14279/2010, an application
for urgent hearing.

Since the case diary is available, the
application is allowed.

Also heard both the parties.

Applicant is in custody in connection with
Crime No.305/2010 registered at Police Station
Nishantpura District Bhopal for the offence
punishable under Sections 420, 467, 468, 471
read with Section 34 of IPC, since 20/7/2010.

Learned counsel for the applicant submits
that in the present case one Dharmanand
Khandpal was the main culprit, who is enlarged on
bail by this Court vide order dated 25/8/2010 in
M.Cr.C.No. 5207/2010. It is alleged that some
seals were seized from the present applicant to
show that he was the person, who forged the
documents, but actually the applicant has no
connection with the case. The entire
misappropriated amount has been deposited by
the Dharmanand Khandpal. The present applicant
has no criminal past within five years. One case
has been registered in the year 2008 that was the
family dispute of the applicant. At present the
applicant may say that he has no criminal past,
therefore he prays for bail.

Learned Public Prosecutor for the State
opposes the application.

After hearing aforesaid arguments and
looking to the facts and circumstances of the case,
without expressing any view on the merits of the
case, I am of the opinion that this is a fit case in
which bail may be granted to the applicant
Dilshad Khan.

Therefore, the application of the present
applicant under Section 439 Cr.P.C is hereby
allowed. He be released on bail on furnishing a
bond in sum of Rs.50,000/- (Rupees fifty thousand)
with one surety of the same amount to the
satisfaction of the Chief Judicial Magistrate,
Bhopal, to appear before the committal Court and
the trial Court on the dates given by the
concerned Courts.
