Background

1. The Applicant filed an RTI application dt.20.5.09 with the PIO, East Coast Railway, Bhubaneswar 

requesting for information against 27 points with regard to the expenditure incurred by Railways in 

connection with the accident of Coromandel express that took place on 14.2.09. Shri J.P.Mishra, 

CPIO replied on 29.6.09 providing interim reply and assuring the Applicant that rest of the information 

would be provided as early as possible. The Applicant filed an appeal dt.19.9.09 with the Appellate 

Authority stating that information was sent in parts  and that all information has not been furnished. 

Shri R.K.Tandon, Appellate Authority replied on 5.11.09 stating that information as available with the 

administration has been provided and added that Applicant may peruse the concerned files available 

with   Khurda   Road   Division   as   well   as   East   Coast   Railway   HQ   office   at   his   convenience.   The 

Applicant then wrote on 10.11.09 to the Appellate Authority stating that he would like to inspect the 

files on 19.11.09 and from 20.11.09 till completion. However the   Applicant   filed a second appeal 

dt.3.12.09 before CIC instead of inspecting the files on the date which he himself had given.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for April 19, 

2010 through video conferencing.  

3. Shri Sanjeev Mehta, CPIO, Shri M.R.Murmu, PIO and Shri L.Patrudu, CPIO/Khurd represented the 

Public Authority and they were present at NIC Studio, Bhubaneswar.

4. The Applicant was not present during the hearing.

Decision

5. The Commission noted from the submissions made by the Respondents that the Appellant  had not 

turned up for inspection of files , maps, charts etc on the dates indicated  by the Appellant  himself 
and hence directs the PIO to allow inspection of files by the Appellant  one more time on a mutually 

convenient date and time and to provide him with attested copies of documents sought  free of cost 

by 19.5.10 and the Appellant to submit a compliance report to the Commission  by 26.5.10.

6. The appeal is accordingly disposed of.
