Affidavit of Sri Prem Prakash, Senior Superintendent of
Police/D.I.G., filed in Court is taken on record.
Vide the averments made in the affidavit, it appears that the
alleged detenu was called for investigation in connection with
case crime no. 1375 of 2009, registered under Sections
307/302/394/34 I.P.C. at P.S. Gomti Nagar, Lucknow.
Accordingly, he was called to Police Station for interrogation
on 10-12-2009 and let off thereafter as recorded in G.D. entry
no. 42 at 18:35 hours on that date.

Thus, nothing would survive in this writ petition, hence it is
dismissed.
